Copyright Policy

Rise lets bakers submit their own recipes to be featured for other bakers in the app. We respect the copyright of others and expect Rise bakers to do the same. This page explains how to tell us about material in Rise that you believe infringes your copyright, and what we do when you tell us.

Designated Copyright Agent

Made by Windmill, LLC has designated the following agent to receive notifications of claimed copyright infringement, as required by the Digital Millennium Copyright Act:

Email is the fastest way to reach our Copyright Agent. Please note that this contact is only for reporting claimed copyright infringement. For anything else, including questions about the app, write to help@bakewithrise.com instead.

Reporting Claimed Infringement

If you believe that material available in Rise infringes a copyright you own or are authorized to act for, please send our Copyright Agent a written notice that includes all of the following:

Your physical or electronic signature.
Identification of the copyrighted work you claim has been infringed. If your notice covers several works in Rise, a representative list of those works is enough.
Identification of the material you claim is infringing, described well enough for us to find it. The title of the featured recipe and the name shown on it are usually the most helpful details, and a screenshot is welcome.
Your contact information, including an address, telephone number, and email address where we can reach you.
A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

Notices that leave out one of these items may not be effective, and may slow down our response while we ask you for the missing piece.

What Happens Next

When we receive a notice that meets the requirements above, we act expeditiously to remove the material from the app or disable access to it. We then take reasonable steps to notify the baker who submitted it that the material has been removed, and we pass along a copy of your notice so that they understand why.

Please keep in mind that when a featured recipe is removed, copies that other bakers have already saved to their own recipe libraries stay on their devices, and we have no way to reach those.

Counter-Notification

If you are a Rise baker and your material was removed because of a notice that you believe was mistaken, or that misidentified your material, you may send our Copyright Agent a written counter-notification that includes all of the following:

Your physical or electronic signature.
Identification of the material that was removed, and the location in Rise where it appeared before it was removed.
A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the United States District Court for the judicial district in which your address is located, or, if your address is outside the United States, of any judicial district in which Made by Windmill, LLC may be found, and that you will accept service of process from the person who filed the original notice or from that person’s agent.

Please understand before you send a counter-notification that the law requires us to forward a copy of it, including the name and address you provide in it, to the person who filed the original notice. If you would rather not share those details with that person, do not send a counter-notification.

If we receive a valid counter-notification, we forward it as described above and let the original complainant know that we may restore the material in ten business days. Unless that person notifies us within that window that they have filed a court action seeking to restrain the activity, we may restore the material within ten to fourteen business days after receiving your counter-notification.

Repeat Infringers

We have adopted a policy of ending the community submission privileges of Rise bakers who repeatedly infringe the copyright of others, and, in appropriate circumstances, of terminating their accounts. We keep a record of notices we receive and act on, and we apply this policy in light of the whole picture, including notices that are withdrawn or successfully answered by a counter-notification.

Misrepresentations

Under Section 512(f) of the Digital Millennium Copyright Act, a person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Please consider carefully, and consult a lawyer if you are unsure, before sending either a notice or a counter-notification.

Other Concerns About a Featured Recipe

Copyright is not the only reason a featured recipe might not belong in Rise. If you have come across something in the app that is offensive, unsafe, or otherwise a problem, you can report it from within the app, or write to hello@bakewithrise.com. We review every report.
